Judicial review is an important aspect of administrative law which focuses on the relationship between the courts and the executive arm of government. This course will focus on some of the interesting and challenging current issues in the Australian law of judicial review.
Topics to be covered include:
- Introduction; Different Approaches to Judicial Review
- Negotiating the Public/Private Distinction
- Judicial Review Remedies: current issues
- The Resurgence of Jurisdictional Error
- Can Invalid Decisions have Legal Consequences?
- Jurisdictional Facts and Irrationality Review
- Privative Clauses and Alternative techniques to restrict judicial review
- Procedural Fairness, the principle of legality, and Judicial Deference.

This course provides a specialist study of one method of administrative law review ? judicial review by courts. The course will approach this topic in three ways:
- by defining the major principles relating to judicial review of administrative action
- by examining recent cases and trends in judicial review
- by noting the functional impact of court review on government administrative decision-making

Students must rely on the Approved Assessment which will be posted to the Wattle course site, prior to the commencement of the course.
