This course aims to provide the ADF Legal Officers' Specialist Officer Career Structure (LOSOCS) with the military administrative law component of Legal Training Module 2. This is the educational requirement for ADF Legal Officers to qualify for legal competency level LL3 under the LOSOCS approved by the Defence Force Remuneration Tribunal.

A student who has successfully completed the course should show a sound knowledge of:

  • the application of Military Administrative Law within the ADF
  • the purpose and application of the Redress of Grievance process
  • the process of administrative inquiries, in the wider context of administrative law

and be able to evaluate the impact of administrative law on Defence Force activities generally.

Learning Outcomes

Upon successful completion, students will have the knowledge and skills to:

  1. Investigate and critically analyse the sources for, and the framework of, administrative law within the ADF and how these relate to the general administrative law framework
  2. Research, and evaluate the application of administrative law principles in military contexts, including but not limited to · administrative fact finding and inquiries · administrative sanctions · redresses of grievance and complaints · command decision-making
  3. Analyse, evaluate and apply civil and military administrative law remedies
  4. Evaluate and apply administrative law and policy in military administrative decision-making, including but not limited to · command decision-making · administrative fact finding and inquiries · administrative sanctions · redresses of grievance and complaints

Indicative Assessment

  1. A multiple choice and short answer test completed in class and/or a class presentation on a topic from a list supplied by the course coordinator (20) [LO 1,2,3]
  2. A case note and/or problem question and/or drafting exercise to be completed within two weeks of completion of the on-campus intensive phase of the course (20) [LO 1,2,3,4]
  3. A notice to show cause and/or inquiry terms of reference drafting exercise and/or provision of advice to Command to be completed within four-five weeks of completion of the on-campus intensive phase of the course (60) [LO 1,2,3,4]

The ANU uses Turnitin to enhance student citation and referencing techniques, and to assess assignment submissions as a component of the University's approach to managing Academic Integrity. While the use of Turnitin is not mandatory, the ANU highly recommends Turnitin is used by both teaching staff and students. Week long intensive seminar with on-line communication and activities before and after.

Requisite and Incompatibility

To enrol in this course you must be studying the Graduate Certificate of Military Law (CMILL) or the Graduate Diploma of Military Law (DMILL).

Prescribed Texts

The prescribed text for this course is R Creyke and J McMillan Control of Government Action LexisNexis 2005.  Additional course materials on CD will be provided to you by the ANU College of Law.

Assumed Knowledge

The course will be taught on the basis that you have an understanding of basic principles of administrative law. You should also be familiar with relevant ADF policies as they relate to administrative law and military operations.
