A student who has successfully completed the course should show a sound knowledge of:

  • the higher level review process for Military administrative law processes
  • the principles underpinning the constitution of and terms of reference for Boards of Inquiry
  • the higher level policy and management issues concerning the design, practice and impact of administrative law processes within the ADF
  • the specialised legislative and human rights developments relevant to administrative law processes within the Defence Force
  • the special requirements for offshore administration of the Defence Force and consequent strategic modifications to administrative practice and tailoring of frameworks for inquiries and personnel management issues
  • government and legislative processes relevant to the formulation of administrative law policy and practice within the Defence Force
  • developments in ADF structural issues relevant to the administrative law practice within the Defence Force
  • privacy law principles and issues from the perspective of the design and implementation of personnel management measures in the Defence Force
  • the exigencies and exemptions provisions of administrative law provisions with regard to the advice and the seeking of approval for exemptions.

Learning Outcomes

Upon successful completion, students will have the knowledge and skills to:

  1. an advanced understanding of applicable legislation and policy in administrative law
  2. an ability to analyse, interpret and apply administrative law
  3. an ability to provide advice on complex military law matters without supervision
  4. an understanding of the law behind Defence policy and an ability to formulate new policy based on sound legal principles
  5. an ability to analyse critically the law applicable to Defence in order to identify and resolve complex issues affecting ADF operations and to make recommendations for change to the law where appropriate
  6. an ability to analyse Military administrative law, practice and policy in the context of societal changes that impact on the ADF administrative system.

Other Information

This course aims to provide ADF Legal Officers' Special Career Structure (LOSCR) with the military administrative law component of Legal Training Module 3.  This is the educational requirement for ADF Legal Officers to qualify for legal competency level LL4 under the LOSCR approved by the Defence Force Remuneration Tribunal.

Indicative Assessment

  1. 100% two-day take home examination to satisfy Defence's competency requirements. (100) [LO null]

To enrol in this course you must be studying the Graduate Diploma of Military Law (DMILL) or the Master of Military Law (7316XMMIL).

You will need to contact the ANU School of Legal Practice to request a permission code to enrol in this course.
