Advances in Artificial Intelligence (AI) is a catalyst for social, economic, scientific, political and legal change in our time. AI powers machine learning, natural language processing, sentiment analysis and complex autonomous systems operating in different domains. Each of these has ramifications for the law and society. The use of algorithmic decision-making and predictive coding by government and in the courts are cause for concern. Future lawyers and other professionals will need to understand the benefits and risks associated with the use of different types of AI in all aspects of social interaction, governance, compliance, risk analysis and business opportunities. The role of AI in social relationships of trust has been explored in science fiction and popular media. Its impact on the markets, elections, global health trends and human relationships is not to be underestimated. Artificial Intelligence, Law, & Society (AILS) is an interdisciplinary module that explores these questions and helps students understand the societal impact of ubiquitous AI, robotics, and automation.
Upon successful completion, students will have the knowledge and skills to:
- Articulate and distinguish the theoretical and philosophical underpinnings of artificial intelligence and its role as a primary catalyst of social, economic, scientific, political and legal change in the 21st century.
- Construct and defend rationales for the use of ‘Legal Technology’ in legal practice, administration, and adjudication, including software applications leveraging Big Data and related techniques to assess litigation risk, recidivism, and 'predict' the outcome of legal cases.
- Evaluate the use of proprietary algorithmic systems to automate legal processes and decision-making in private and public sector contexts.
- Critically analyse the ways that AI is shaping and changing life, work and leisure in the 21st century.
- Plan and conduct a project to research and critically analyse the societal impact of AI and the role of law in mediating its potential harms, and actualising its benefits.

The ANU is using Turnitin to enhance student citation and referencing techniques, and to assess assignment submissions as a component of the University's approach to managing Academic Integrity. For additional information regarding Turnitin please visit the Academic Integrity . In rare cases where online submission using Turnitin software is not technically possible; or where not using Turnitin software has been justified by the Course Convener and approved by the Associate Dean (Education) on the basis of the teaching model being employed; students shall submit assessment online via ‘Wattle’ outside of Turnitin, or failing that in hard copy, or through a combination of submission methods as approved by the Associate Dean (Education). The submission method is detailed below.
Moderation of Assessment
Marks that are allocated during Semester are to be considered provisional until formalised by the College examiners meeting at the end of each Semester. If appropriate, some moderation of marks might be applied prior to final results being released.
For all courses taught in any mode (whether face to face or online), the ANU College of Law considers participation in the classes offered to be an important part of the educational experience of the graduate program. Students are expected to attend all classes.
If circumstances arise which are beyond a student’s control and they are unable to attend a class, the student should contact the Course Convenor in advance (where possible), so that the convenor can adjust their expectations in relation to numbers for that class. If it is not possible to give advance notice, students should send the convenor an email as soon as possible with evidence to support the reason for failure to attend.
Assessment Task 1
Learning Outcomes: 1, 2, 3, 4, 5
Details of Task: Students must answer 30 multiple choice questions to be completed within 60 minutes. The questions will focus on topics covered from Classes 1-6 of the course.
Nature of the task: Compulsory. Failure to participate will result in 0 marks for this task. If you experience unavoidable and extenuating circumstances and cannot sit the quiz at the due date and time, you should apply for an extension to the College of Law student admin team here:
The College will give you one opportunity to sit the quiz, at the same time one week later. This will be your final opportunity to sit the quiz.
Release: Friday 3 September 2021, 5 pm.
Due: Monday 6 September 2021, 5pm via WATTLE. Submissions after the due date will not be accepted.
Estimated return date: Once all eligible students have sat the quiz.

Assessment Task 2

Brief description: Effective participation in this course requires around 6-8 hours of reading each week.
Preparation and participation in the live classes and online discussion forums is a critical element of the learning required in the course. To enhance your learning further in this course, you will also need to access regularly the course Wattle site. Live classes and online discussion forums will provide opportunities to share reflections and to collaborate in small groups such as through class exercises, so that students can receive immediate feedback, as well as seek further clarification to improve their understanding in preparation for assessment tasks.
Nature of Task: Compulsory and non-redeemable. Failure to complete this task will result in a mark of 0.
Assessment Criteria: In class and online discussion should demonstrate an understanding of the course content.
Assessment Task 3
Learning Outcomes: 1, 2, 3, 4, 5
Details of Task: The research essay will require students to conduct independent research that investigates a theme, issue, or policy underlying the impact of Artificial Intelligence on law and society. Original research will be required.
Nature of Task: The research essay is compulsory. Non-completion of this task will result in a 0 for this assessment task.
Word Limit: 3,600 words
Topic of Essay: Students have two options for the essay topic: (1) they may choose from a list of topics that will be made available by 5 pm, Monday 25 August 2021 on Wattle; (2) Students who wish to work on any other topic outside this list for their final research essay must consult the course convener by email or by appointment and finalise their topic on or before 5 September 2021. Students cannot work on any topic for their final research essay without the express permission of the convener.
Due Date: Monday, 11 October 2021, at 5 pm via Turnitin. Students must submit the essay electronically via the Wattle and Turnitin dropboxes on the course Wattle site. Late submissions (without an extension) are permitted, although late penalties will apply.
Estimated Return Date: Within approximately three weeks of the submission date.

You will be required to electronically sign a declaration as part of the submission of your assignment. Please keep a copy of the assignment for your records. Unless an exemption has been approved by the Associate Dean (Education) submission must be through Turnitin.
For some forms of assessment (hand written assignments, art works, laboratory notes, etc.) hard copy submission is appropriate when approved by the Associate Dean (Education). Hard copy submissions must utilise the Assignment Cover Sheet. Please keep a copy of tasks completed for your records.
Individual assessment tasks may or may not allow for late submission. Policy regarding late submission is detailed below:
- Late submission not permitted. If submission of assessment tasks without an extension after the due date is not permitted, a mark of 0 will be awarded.
- Late submission permitted. Late submission of assessment tasks without an extension are penalised at the rate of 5% of the possible marks available per working day or part thereof. Late submission of assessment tasks is not accepted after 10 working days after the due date, or on or after the date specified in the course outline for the return of the assessment item. Late submission is not accepted for take-home examinations.

Extensions and Penalties
Extensions and late submission of assessment pieces are covered by the Student Assessment (Coursework) Policy and Procedure. Extensions may be granted for assessment pieces that are not examinations or take-home examinations. If you need an extension, you must request an extension in writing on or before the due date. If you have documented and appropriate medical evidence that demonstrates you were not able to request an extension on or before the due date, you may be able to request it after the due date.
Distribution of grades policy
Academic Quality Assurance Committee monitors the performance of students, including attrition, further study and employment rates and grade distribution, and College reports on quality assurance processes for assessment activities, including alignment with national and international disciplinary and interdisciplinary standards, as well as qualification type learning outcomes.
Since first semester 1994, ANU uses a grading scale for all courses. This grading scale is used by all academic areas of the University.
