The course examines some contemporary issues in the law of torts and builds on learning undertaken in LAWS1203.
The course will examine the interaction of tort law and public law, with particular focus on government liability in negligence. It will also consider false imprisonment and torts relating to trespass to goods, misfeasance in public office, malicious prosecution, breach of statutory duty, nuisance, negligent misstatements, negligent infliction of pure economic loss and the economic torts. It will also include an overview of direct and vicarious liability, defenses and remedies.
Learning Outcomes
Upon successful completion, students will have the knowledge and skills to:
- Critically analyse and apply the principles of tort law as it relates to public law.
- Compare the various issues specific to government liability in negligence.
- Propose solutions to complex legal problems and communicate these to a variety of audiences.
- Plan, and conduct research with some independence to critically discuss various aspects of liability in tort.

Workload
- Classes offered in non-standard sessions will be taught on an intensive base with compulsory contact hours (approximately 36 hours of face to face teaching). The course will also require advanced preparation through assigned readings. In total, it is anticipated that the hours required for completion of this course (class preparation, teaching and completion of assessment) will not exceed 120 hours.
- Classes offered during semester periods are expected to have three contact hours per week. Students are generally expected to devote at least 10 hours overall per week to this course.
