The course examines some contemporary issues in the law of torts and builds on learning undertaken in LAWS1203.
The course will examine the interaction of tort law and public law, with particular focus on government liability in negligence. It will also consider false imprisonment, misfeasance in public office, malicious prosecution, breach of statutory duty and negligent misstatements. It will also include an overview of direct and vicarious liability, defences and remedies.
Learning Outcomes
Upon successful completion, students will have the knowledge and skills to:
- Critically reflect on the principles of tort law as it relates to public law,
- Compare and critique the various issues specific to government liability in negligence,
- Propose solutions to complex legal problems and communicate these to a variety of audiences,
- Independently plan and conduct research to critically discuss various aspects of liability in tort.

Workload
Classes offered in non-standard sessions will be taught on an intensive base with compulsory contact hours (approximately 26 hours of face to face teaching). The course will also require advanced preparation through assigned readings. In total, it is anticipated that the hours required for completion of this course (class preparation, teaching and completion of assessment) will not exceed 120 hours.
Classes offered during semester periods are expected to have three contact hours per week.
