SELT Survey Results

This course will focus on the frequently and rapidly changing framework of Skilled, Business Innovation and Investment migration to Australia. It is designed to enable students to understand the background to, and working mechanisms of, these highly complex, visa systems. The course looks at the boundaries and commonalities between skilled, business innovation and investment visa classes focusing on the requirements of the most common skilled visa subclasses and recently introduced new skilled, business innovation and investment visas. Students will be equipped with theory, practical knowledge and cognitive skills to enable them to further their careers as subject matter experts, specialist researchers and/or mentors of practicing professionals.

By the conclusion of this course, it is expected that students who have successfully completed all of the course requirements should be able to:
  1. Develop and maintain comprehensive and current knowledge of the legislation, jurisprudence and policy surrounding skilled and business migration.
  2. Apply knowledge and skills to provide accurate and detailed advice to clients about their skilled and business innovation and investment migration opportunities
  3. Engage in theoretical and practical discourse about the factors and contexts that shape Australia Migration Law, policy and practice in the areas of skilled, business innovation and investment migration.
  4. Design and implement an independent, research based project in the areas of skilled, business innovation or investment migration law/policy/practice.
  5. Utilise advanced communication skills to advocate at a high level a coherent and sustained argument in a variety of settings and formats.

Required Resources

You are required to read all the materials that are made available via the course site and view/listen to all audio-casts that may be offered as part of the course. New materials will be announced using the course announcements forum.

You are expected to carry out independent research during the course to complete some of the assessments (as you would be expected to do in practice). You can undertake virtually all of the beneficial independent research online. You must thoroughly study your jurisdictions legislation relevant to wills and estates practice, as directed throughout the course.

You will be given written and/or oral feedback pointing out things that have been done well and those that could be done better or differently. You will be given written or oral feedback following any submission of an assessment. This is typically available 1-4 weeks after submission of the assessment. Referencing Requirements

Where required, students must use footnotes for referencing and the Australian Guide to Legal Citation 4th edition (http://www.law.unimelb.edu.au/mulr/aglc) for the citation style.


Word Limits

The method of calculation of word length for assessment pieces in this course is a global word count. This means that when calculating the number of words of a piece of assessment students must include all headings, text, and footnotes (excluding bibliography). Students should calculate this using Microsoft Word’s word count function or equivalent. The default penalty is as follows: the mark which is awarded initially will be reduced by half the proportion by which the word limit has been exceeded. As an example, if the word limit is 2,000 words, and the essay submitted is 3,000 words long, then the initial mark for the essay would be reduced by 25% of that mark.

Papers which fall short of words will not be penalised on that basis alone. However, short papers risk failing to address the question adequately.

ANU has educational policies, procedures and guidelines, which are designed to ensure that staff and students are aware of the University’s academic standards, and implement them. Assessment Requirements

The ANU is using Turnitin to enhance student citation and referencing techniques, and to assess assignment submissions as a component of the University's approach to managing Academic Integrity. For additional information regarding Turnitin please visit the ANU Online website. In rare cases where online submission using Turnitin software is not technically possible; or where not using Turnitin software has been justified by the Course Convener and approved by the Associate Dean (Education) on the basis of the teaching model being employed; students shall submit assessment online via ‘Wattle’ outside of Turnitin, or failing that in hard copy, or through a combination of submission methods as approved by the Associate Dean (Education). The submission method is detailed below.

Moderation of Assessment

Marks that are allocated during Semester are to be considered provisional until formalised by the College examiners meeting at the end of each Semester. If appropriate, some moderation of marks might be applied prior to final results being released.

Participation

This is an online course. Students will study online and are expected to devote 10-12 hours per week to studying, participating online in group forum discussions and online classes on Adobe Connect and conducting individual research.

You are strongly encouraged to participate in online activities. This includes posting in Discussion Forum activities, participating in online classes (whenever you can) and watching recordings of classes, lectures and other video resources. Resources and materials will be provided online. You will also be expected to undertake your own private research in addition to the readings and forum discussions.

You are also strongly encouraged to participate in the Tribunal observation activity (further information will be available in the course site). It is migration law in action and previous students have found the observation activities very interesting and informative.

You must check Wattle course announcements and forum discussions as well as your ANU email at least every 24-48 hours.

All email correspondence from the ANU will be sent to your ANU email address. You may arrange for your ANU Email to be forwarded to an email address you check daily.

Alternatively, set your personal setting to provide you with all the reminders you need to achieve this. At the end of the day, it is your responsibility to ensure you are actively committed and involved in this course.

Research Essay Proposal (10%)

Format: Essay Proposal.

Relationship between Assessment Task and the Course Objectives: In this Assessment Task students will be required to choose a topic for their research essay from a defined set of issues discussed in Topic 1 and/or Topic 2 course materials and contribute their independent research findings. Students will be required to prepare their

essay proposal following the guidelines provided. The proposal will assist students in developing their research skills. 

Approval of Topic: Guidelines available from Tuesday, 12 August 2019. Essay Proposal Topic must be approved by the Convenor for the submission of Assessment 2 to be accepted.

Due date: Monday, 26 August 2019 11:55pm (AEST).

Word limit: 800 words including all headings, tables, text, and footnotes. 

Estimated return date: Monday, 02 September 2019.

Understanding and addressing issues

  • The issues raised by the topic are considered, clearly identified and presented by the student.

Argument and analysis

  • The student demonstrates their ability to develop an analysis or an argument through close consideration of the proposed topic and the appropriate use of research materials.

Research Essay (40%)

Format: Essay

Relationship between Assessment Task and the Course Objectives: The Essay will test Learning Outcomes 3, 4 and 5 (LO3, LO4, and LO5). Students will choose one question with a research focus from a selection provided. The assessment will allow students to develop their understanding of Australia’s skilled and business visa system, including relevant migration legislation and policy. The essay will develop skills in reflective writing, analysis and research that will assist in addressing current issues arising in Australian immigration law and policy. Students will draw on key topics and issues they have addressed through their course readings, resources, discussion forums and Adobe classes while studying Topics 1-3. Independent research will be essential to succeed in this assessment.

Submission Date: Monday, 23 September 2019 11.55pm (AEST)

Length: 3200 words inclusive of footnotes.

Estimated Date of Results: The marked assessment and individualised feedback will be returned to students by Thursday, 31 October 2019

Presentation, style and referencing

  • The student presents their essay with a clear and concise expression that is stylistically appropriate with good use of structure, paragraphs and section headings where applicable.

Format: Letters to client

Relationship between Assessment Task and the Course Objectives: This assessment relates to Learning Outcomes 1, 2 and 5 (LO1, LO2, and LO5). It allows students to apply their in-depth knowledge of migration law and policy of skilled and business visas and advise clients of eligibility and visa grant requirements as well as details of relevant visa application processes (LO1). Students will be expected to provide sufficiently detailed, clearly worded advice on skilled and business visa and make sound recommendations to their clients (LO2, LO5). Students will be offered choices of case study scenarios amended with further details; each student will be required to choose one skilled and one business visa scenario and produce a detailed letter of advice to their client covering eligibility to apply, grant criteria and the application process.

Submission Date: Friday, 25 October 2019 11.55pm (AEDT)

Length: 4000 words inclusive of footnotes.

Late Submission

Policy regarding late submission is detailed below:

  • Late submission permitted. Late submission of assessment tasks without an extension are penalised at the rate of 5% of the possible marks available per working day or part thereof. Late submission of assessment tasks is not accepted after 10 working days after the due date, or on or after the date specified in the course outline for the return of the assessment item. Late submission is not accepted for take-home examinations.

Referencing Requirements

Alternatively, you can seek help through the Students Learning Development website.

Returning Assignments

Your written work will receive feedback and grading via the course Wattle site under the corresponding assessment drop box. Assessment results are typically available between 1-4 weeks after the due date via the same dropbox your assessments were submitted to. The Convenor will post announcements about when you can expect your assessment results.


Extensions and Penalties

Extensions and late submission of assessment pieces are covered by the Student Assessment (Coursework) Policy and Procedure. The Course Convener may grant extensions for assessment pieces that are not examinations or take-home examinations. If you need an extension, you must request an extension in writing on or before the due date. If you have documented and appropriate medical evidence that demonstrates you were not able to request an extension on or before the due date, you may be able to request it after the due date.

Privacy Notice

The ANU has made a number of third party, online, databases available for students to use. Use of each online database is conditional on student end users first agreeing to the database licensor’s terms of service and/or privacy policy. Students should read these carefully. In some cases student end users will be required to register an account with the database licensor and submit personal information, including their: first name; last name; ANU email address; and other information.
In cases where student end users are asked to submit ‘content’ to a database, such as an assignment or short answers, the database licensor may only use the student’s ‘content’ in accordance with the terms of service – including any (copyright) licence the student grants to the database licensor. Any personal information or content a student submits may be stored by the licensor, potentially offshore, and will be used to process the database service in accordance with the licensors terms of service and/or privacy policy.
If any student chooses not to agree to the database licensor’s terms of service or privacy policy, the student will not be able to access and use the database. In these circumstances students should contact their lecturer to enquire about alternative arrangements that are available.

Distribution of grades policy

Academic Quality Assurance Committee monitors the performance of students, including attrition, further study and employment rates and grade distribution, and College reports on quality assurance processes for assessment activities, including alignment with national and international disciplinary and interdisciplinary standards, as well as qualification type learning outcomes.

Since first semester 1994, ANU uses a grading scale for all courses. This grading scale is used by all academic areas of the University.

Research Interests


Gabor Hajdu has taught courses in the Graduate Certificate in Australian Migration Law and Practice since he joined the ANU Legal Workshop in 2013.

In the Master of Laws (LLM) program, he has convened LAWS8650 – Applied Australian Migration Law and Practice (the Practice Ready Program), LAWS8651 – Fundamentals of Australian Migration Law, LAWS8652 – Administrative Decision making in Australian Migration Law, LAWS8653 – Contemporary Issues in Migration Law and LAWS8658 – Skilled and Business Migration.

Gabor has extensive experience in teaching and working both in the migration area and management at senior levels in the Australian Public Service. He runs his own migration practice and is a NAATI certified and accredited translator and interpreter.

Gabor’s research interests are citizenship, examination practices in online courses and students’ performance in online exams.
